1. Acceptance of Terms

By accessing or using Brain Health Playground ("BHP"), you agree to be bound by these Terms of Use. If you do not agree, do not use the platform. BHP is operated by youngand Inc.

2. Service Description

BHP is a web-based cognitive wellness platform that provides interactive games designed to engage and stimulate cognitive function in senior adults. The platform is intended for use at adult day care centers and senior wellness facilities.

BHP is a wellness and educational tool. It is not a medical device, diagnostic tool, or substitute for professional medical advice, diagnosis, or treatment.

3. User Accounts

  • Center Staff Accounts — Staff members register with email and password. You are responsible for maintaining the security of your credentials.
  • Senior Participants — Participant profiles are created and managed by authorized center staff. Participants do not have independent login credentials.
  • You must provide accurate information and update it as necessary.

4. Acceptable Use

You agree not to:

  • Use BHP for any unlawful purpose
  • Attempt to access data belonging to other centers
  • Reverse-engineer, copy, or distribute the platform or its games
  • Share login credentials with unauthorized individuals
  • Input false or misleading participant information
  • Use the platform in any way that could harm participants

5. Camera Usage

Certain games use your device's camera for body-tracking interaction via MediaPipe technology. By using these features, you acknowledge that:

  • Camera processing occurs entirely on-device in the browser
  • No images or video are captured, stored, or transmitted
  • Camera access can be denied at any time through browser settings
  • Center staff must ensure participants are informed about and comfortable with camera-based interaction before use

6. Intellectual Property

All content, games, designs, and software comprising BHP are the property of youngand Inc. and are protected by applicable intellectual property laws. You may not reproduce, modify, or create derivative works without written permission.

7. Subscription and Billing

  • BHP offers a 30-day free trial for new centers
  • After the trial, continued use requires a paid subscription
  • Subscription fees are billed monthly or annually
  • You may cancel at any time; access continues through the end of the billing period
  • Refunds are not provided for partial billing periods

8. Disclaimer of Warranties

BHP is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that:

  • The platform will be uninterrupted or error-free
  • Game results reflect clinical cognitive assessments
  • The platform will produce any specific health outcomes

9. Limitation of Liability

To the maximum extent permitted by law, youngand Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of BHP, including but not limited to physical injury during game play, data loss, or service interruptions.

Center operators are responsible for ensuring a safe physical environment for participants during game play and for supervising participants as appropriate.

10. Indemnification

You agree to indemnify and hold harmless youngand Inc. from any claims arising from your use of BHP, your violation of these Terms, or any third-party claims related to your center's use of the platform.

11. Termination

We may suspend or terminate your account if you violate these Terms. Upon termination, your data will be retained for 30 days and then permanently deleted. You may request immediate data deletion per our Privacy Policy.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States. Any disputes shall be resolved in the courts of California.

13. Changes to These Terms

We may update these Terms from time to time. We will notify center administrators of material changes via email. Continued use of BHP after changes constitutes acceptance of the revised Terms.
